PRIVACY POLICY
Boobs On The Run Pty Ltd trading as Running Roxstars (ABN 75 612 183 954) (Running Roxstars, we, us, our) is committed to protecting the privacy of your personal information. This Privacy Policy explains how we collect, hold, use, and disclose personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
By using our services or enrolling in our programs, you (and, where you are a parent or guardian enrolling a child, on behalf of your child) consent to the collection, use, storage , and disclosure of your personal information as described in this Privacy Policy.
1. WHAT PERSONAL INFORMATION WE COLLECT
We collect personal information that is necessary to provide our programs and services. This includes:
Parent and guardian information:
- full name, address, email address, and phone number;
- emergency contact details;
- payment and billing information.
Child participant information:
- full name, date of birth, and age;
- school year and program stream;
- photographs or video footage taken during sessions (where the express consent of the parent or guardian has been given, as described in clause 10.2).
Health and medical information:
- medical conditions, including asthma and other conditions relevant to physical activity;
- medications carried during sessions;
- injury history and physical limitations;
- emergency medical authorisation details.
We treat health information as sensitive information and handle it with additional care in accordance with APP 3 and APP 6.
2. HOW WE COLLECT PERSONAL INFORMATION
We collect personal information:
- directly from you when you create an account, complete our online enrolment form, or Health and Wellness Questionnaire;
- via email, text message, or telephone communications with us, including through the appropriate third party products such as Hubspot or Mailchimp;
- through our website, including via cookies and third-party analytics tools (e.g., Google Analytics); and
- through photography or video recording at sessions, where you have consented.
We will only collect sensitive information (including health information) with your express consent or where required or authorised by law.
3. WHY WE COLLECT PERSONAL INFORMATION
We use personal information to:
- enrol participants in our programs and manage their participation;
- communicate with you about sessions, schedules, cancellations, and updates;
- respond to your enquiries and provide customer support;
- process payments and manage accounts;
- ensure the safety and wellbeing of participants, including appropriate management of medical conditions;
- comply with our legal obligations, including child safety and mandatory reporting obligations;
- improve our programs and services; and
- send you program updates and news (you may opt out at any time).
4. DISCLOSURE OF PERSONAL INFORMATION
We may disclose personal information to:
- Running Roxstars coaches and contractors, for session delivery and safety management;
- venue partners, to the extent necessary for session delivery;
- emergency services or medical professionals, where necessary to protect a participant's health or safety;
- technology and payment service providers (e.g., booking platforms, payment processors), who are contractually required to handle personal information in accordance with the APPs; and
- government or regulatory authorities, where required or authorised by law.
We do not sell personal information to third parties.
We are obligated by law to report certain matters to relevant authorities, including where there is a reasonable belief that a child under 18 years is at risk of harm. This may require disclosure of personal information.
5. STORAGE AND SECURITY
5.1 We store personal information securely and take reasonable steps, including appropriate technical and organisational measures such as password protection and access controls, to protect it from misuse, interference, loss, and unauthorised access, modification, or disclosure.
5.2 We retain personal information only for as long as is necessary for the purpose for which it was collected, or as otherwise required by law. As a general rule, we retain enrolment, health, and account records for up to seven (7) years after a participant's last engagement with our programs (or longer where required by law), after which we securely destroy or de-identify the information.
5.3 Some of our service providers (e.g., cloud storage or booking systems) may store or process information outside of Australia. Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure that the recipient does not breach the APPs in relation to that information, or that an exception under APP 8 applies (for example, where the recipient is subject to a substantially similar privacy regime that you can enforce, or where you have consented to the disclosure after being informed that APP 8.1 will not apply).
5.4 If we experience a data breach involving your personal information that is likely to result in serious harm, we will assess the breach and, where required, notify you and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme under the Privacy Act.
5.5 We do not use your personal information in automated decision-making processes that could significantly affect you. If this changes, we will update this Privacy Policy to describe the kinds of personal information used and the nature of those decisions, in accordance with our obligations under the Privacy Act.
6. ACCESS, CORRECTION, AND DELETION
You have the right to request access to or correction of personal information we hold about you or your child. You may also request deletion of personal information, which we will action where we are legally permitted to do so and the information is no longer required for any purpose described in this Privacy Policy or otherwise required by law.

We will respond to requests within a reasonable time and, where required, in accordance with the APPs. We may be required by law to retain certain information.
7. COOKIES AND WEBSITE ANALYTICS

9. CHILDREN
9.1 We will not use a child's photograph or video footage, or send marketing communications concerning a child, without the express consent of the child's parent or guardian, which may be withdrawn at any time.
9.2 We will handle children's personal information in accordance with the Australian Privacy Principles and any applicable Children's Online Privacy Code, and will update our practices as required when that Code commences.
9.3 Our programs are designed for children, and we take particular care with children's personal information. We collect personal information about a child only from, or with the authorisation of, the child's parent or guardian, and we use it solely for the purposes of delivering our programs and ensuring participant safety.
