TERMS AND CONDITIONS FOR PROGRAM ENROLMENT

Boobs On The Run Pty Ltd trading as Running Roxstars (ABN 75 612 183 954) of 1 Gladstone Street, Concord NSW 2137 (Running Roxstars, we, us, our).

These Terms and Conditions (Terms) apply to the enrolment of all participants in Running Roxstars programs. By completing an online booking or enrolment, the parent or guardian (Parent, you, your) agrees to these Terms on behalf of themselves and the child participant. We may update these Terms from time to time. We will give you reasonable notice of any material change by email and by publishing the revised Terms on our website. If you do not agree to a material change, you may cancel your enrolment before the change takes effect and we will refund any pre-paid fees for sessions not yet attended. Your continued enrolment or participation after the change takes effect constitutes your acceptance of the changes.

If you do not agree with any part of these Terms, please do not proceed with enrolment.

1.  OUR PROGRAMS

Running Roxstars offers the following youth running programs for participants aged 8 to 15 years:

Rising Runners (ages 8–11 and 12–15):

Weekly 1-hour sessions for participants who can run for at least 2 minutes continuously. Sessions include warm-up, games, running drills, education, and warm-down.

Running Roxstars — Hyrox Youngstars Training (ages 8–11 and 12–15):

Weekly 1-hour sessions for participants engaged in strength training with a view to competing in Hyrox Youngstars events.

Mid Week Run Club (ages 8–11 and 12–15):

Weekly 1-hour sessions for participants looking to develop their love of running and running technique. Sessions include a 4km run, drills, and education.

All programs are held at public running tracks, parks, and gyms across Sydney. Venue details are communicated prior to each session. Running Roxstars does not own or operate the venues at which sessions are held and is not responsible for the condition, maintenance, or safety of those venues. Participants and parents must comply with all applicable venue rules and regulations.

2.  ELIGIBILITY

2.1  Participants must be aged between 8 and 15 years.

2.2  Participants must meet the ability requirements for the relevant program stream as described on our website.

2.3  By enrolling your child, you confirm that they meet the relevant eligibility requirements and that you are their parent or legal guardian.

3.  ENROLMENT AND ACCOUNT

3.1  Enrolment is completed online via our website at www.runningroxstars.com.au.

3.2  You must create an account to make a booking. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3.3  You agree to provide accurate, complete, and up-to-date information at the time of enrolment and to update your account promptly if your information changes.

4.  FEES AND PAYMENT

4.1  Program fees are as displayed on our website. We may change our fees from time to time on reasonable advance notice published on our website. Any change to fees will not affect sessions you have already booked and paid for, or sessions within a Class Pack purchased before the change takes effect.

4.2  Payment is required at the time of booking, in full and in advance.

4.3  All prices are in Australian dollars (AUD). GST is included unless stated otherwise.

4.4  We offer Class Packs at a reduced rate. Class Packs expire 12 weeks from the date of purchase unless otherwise stated on our website. Unused sessions in a Class Pack are not refundable or creditable after expiry.

4.5  Except where required by the Australian Consumer Law, all payments are non-refundable. If you wish to credit a payment to a future session, please contact us at info@runningroxstars.com.au. Credits are granted at our sole discretion.

5.  WAITLISTS

5.1  If a session is full, you may register for the waitlist.

5.2  If a spot becomes available, we will notify you by email and automatically confirm your booking. Please check your email regularly.

5.3  Once confirmed from the waitlist, our Cancellation Policy in clause 6 applies.

6.  CANCELLATIONS AND MAKEUP SESSIONS

6.1  Cancellations must be made by text or email to info@runningroxstars.com.au at least 24 hours before the session start time.

6.2  Cancellations made at least 24 hours in advance do not incur a charge. A makeup session credit will be available.

6.3  Cancellations made less than 24 hours before the session: the full session fee applies and no makeup credit is provided.

6.4  Makeup sessions are available for eligible cancellations and are subject to availability. Makeup sessions must be booked directly with us.

6.5  Special classes and arrangements: If your child requires special accommodation (including due to disability, injury, or other needs), please contact us directly at info@runningroxstars.com.au so that we can work through suitable arrangements with you.

7.  SCHEDULE CHANGES

7.1  Session schedules and venues may change from time to time. We will use reasonable efforts to notify you of any changes to the schedule or venue as soon as practicable.

7.2  We are not liable to provide compensation for sessions cancelled or modified due to circumstances outside our control, including weather, venue unavailability, or government restrictions. However, where a session is cancelled by us and cannot be rescheduled, we will provide a makeup session credit or, at our discretion, a credit to future sessions.

7.3  We will not be liable for any failure or delay in performing our obligations under these Terms to the extent that such failure or delay is caused by a Force Majeure Event. A "Force Majeure Event" means any event beyond our reasonable control, including but not limited to natural disasters, pandemics, epidemics, government orders, public health emergencies, extreme weather, fire, flood, acts of terrorism, strikes, utility failures, or venue closures. We will use reasonable efforts to notify you of any Force Majeure Event and its expected duration.

8.  MEDICAL CONDITIONS AND HEALTH DISCLOSURE

8.1  Before your child's first session, you must disclose all relevant medical conditions, injuries, or health concerns via the Health and Wellness Questionnaire provided at enrolment.

8.2  If your child has asthma or any condition requiring medication during physical activity, you must:

• disclose this on the Health and Wellness Questionnaire;

• ensure your child brings their prescribed medication (including asthma puffer) to every session; and

• inform the Running Roxstars coach at the commencement of each session.

8.3  You must notify us promptly of any change in your child's health status.

8.4  Our coaches are not medically trained and are not qualified to assess medical fitness. You acknowledge that participation in physical running programs carries inherent risks of injury. Subject to your rights under the Australian Consumer Law and to our obligation to exercise due care and skill, you acknowledge and accept the inherent risks associated with your child's participation in the Programs.

8.5  In the event of a medical emergency during a session, we are authorised to:

• administer first aid and CPR where deemed necessary;

• arrange emergency medical care or transportation; and

• consent to medical treatment by qualified medical personnel.

8.6  You agree to assume all costs of emergency medical care and transportation.

8.7  You must provide at least one emergency contact (in addition to yourself) at the time of enrolment. You are responsible for ensuring emergency contact details are accurate and up to date at all times.

9.  CONDUCT

9.1  Participants are expected to:

• follow all instructions from Running Roxstars coaches;

• treat other participants, coaches, and venue property with respect;

• arrive on time and in appropriate clothing and footwear;

• not participate if unwell or injured.

9.2  We reserve the right to remove a participant from a session or terminate their enrolment if their conduct poses a safety risk or is disruptive to others.

9. You are responsible for the drop-off and pick-up of your child at each session. Participants must be collected promptly at the end of each session. Running Roxstars coaches are not responsible for supervising participants before or after scheduled session times. If a participant is not collected within 15 minutes of the session ending, we may attempt to contact you using the details on your account. Running Roxstars accepts no responsibility for participants outside of scheduled session time.

9.4  Without limiting clause 9.2, we may suspend or terminate a participant's enrolment if: (a) you breach any of these Terms; (b) fees remain unpaid after we have given you notice and a reasonable opportunity to pay; (c) you provide false or misleading information; or (d) we reasonably determine on genuine grounds that continued participation poses a risk to the safety or welfare of the participant, other participants, or our staff. Where we terminate under this clause for reasons not attributable to your or your child's conduct or breach, we will refund or credit the fees for any sessions not yet attended. Otherwise, no refund of fees is payable except where required by the Australian Consumer Law

9.5  You may withdraw your child from a program at any time by notifying us in writing at info@runningroxstars.com.au. Withdrawal does not entitle you to a refund of any pre-paid fees or unused Class Pack sessions, except where required by the Australian Consumer Law.

10.  PHOTOGRAPHY AND MEDIA

10.1  We may photograph or film sessions for promotional purposes. By enrolling your child, you consent to our use of images or footage of your child for these purposes, unless you notify us in writing that you do not consent.

10.2  Parents and guardians must not photograph or film other participants without the consent of their parent or guardian.

10.3  All intellectual property in the Programs, including but not limited to program names, logos, training plans, educational materials, and content provided during sessions, remains the property of Running Roxstars. You must not reproduce, distribute, or commercially exploit any such materials without our prior written consent.

11.  PRIVACY

We collect and handle personal information in accordance with our Privacy Policy, available at www.runningroxstars.com.au. By enrolling, you consent to the collection, use, and disclosure of personal information as described in that policy.

12.  PROPERTY

You are responsible for your and your child's personal belongings at all times. To the extent permitted by law, Running Roxstars is not responsible for any loss of, or damage to, personal property brought to a session. 

13. WEATHER

 As sessions are conducted outdoors, we may modify, postpone, or cancel a session where we reasonably consider that weather or environmental conditions (including extreme heat, poor air quality, storms, or unsafe surfaces) pose a risk to participants. Where a session is cancelled by us under this clause and cannot be rescheduled, clause 7.2 applies.

14. CHILD SAFETY AND SUPERVISION

14.1  Running Roxstars is committed to providing a safe environment for all participants. Our coaches and staff who work with children hold a current Working With Children Check (or equivalent clearance) as required by applicable law.

14.2 We maintain child protection and safeguarding policies and procedures, available on request. You must promptly raise any child safety concern with us at info@runningroxstars.com.au. Parents, guardians, and spectators attending sessions must behave respectfully towards participants, coaches, staff, and other attendees, and must follow the reasonable directions of our coaches and all venue rules. We may require any person whose conduct is unsafe, abusive, or disruptive to leave a session.

15. LIMITATION OF LIABILITY

15.1  To the extent permitted by law, Running Roxstars' liability to you for any claim arising out of or in connection with these Terms or the Programs is limited to the fees paid for the relevant session.

15.2  We exclude liability for indirect, special, or consequential loss, including loss of enjoyment or opportunity.

15.3  Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other applicable legislation that cannot be excluded by agreement.

15.4  You agree to indemnify Running Roxstars, its officers, employees, coaches, contractors, and agents against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; or (b) any negligent or wrongful act or omission of you or your child in connection with the Programs. This indemnity is reduced proportionately to the extent that our negligence, wilful misconduct caused or contributed to the relevant loss.

15.5  Enrolment in the Programs is conditional on the parent or guardian signing our Participant Waiver, Release and Indemnity (Waiver). To the extent of any inconsistency in relation to any claim for personal injury, illness, or death arising out of or in connection with a participant's involvement in the Programs, the Waiver prevails over clauses 8.4 and 12 of these Terms. Nothing in this clause limits any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law.

16.  INSURANCE 

Running Roxstars holds public liability insurance. We do not hold personal accident or medical insurance for participants. You are responsible for arranging any personal accident, ambulance, or medical insurance you consider appropriate for your child.\n\n16.  

17. DISPUTES

If you have a complaint or dispute, please first contact us at info@runningroxstars.com.au so that we can try to resolve it. Both parties agree to attempt to resolve any dispute in good faith before commencing court proceedings, except where urgent interlocutory relief is required

18. MISCELLANEOUS

These Terms are governed by the laws of New South Wales, Australia, and you and Running Roxstars submit to the non-exclusive jurisdiction of the courts of New South Wales.

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to a third party, provided that the assignee agrees to be bound by these Terms and the assignment does not reduce your rights or increase your obligations under these Terms.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect. A failure or  us toy by exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy, nor does any single or partial exercise of a right or remedy preclude any further exercise of that or any other right or remedy.

These Terms, together with our Privacy Policy and any documents expressly incorporated by reference, constitute the entire agreement between you and Running Roxstars in relation to the Programs and supersede all prior representations, agreements, or understandings.
